§ 3 TECHNICAL REQUIREMENTS

  1. The following are necessary to use the digital content covered by the Terms:

    • an active e-mail account,
    • a device with Internet access (computer, tablet or smartphone),
    • a web browser supporting JavaScript and cookies,
    • speakers or headphones enabling sound playback — to use the Bonus in the form of a video lesson.
  2. The Service Provider is not liable for technical problems resulting from the Service Recipient's failure to meet the above requirements.

§ 4 AGREEMENT

  1. The Service Recipient may voluntarily subscribe to the Newsletter and receive the Bonus.

  2. In order to receive the Newsletter and the Bonus, it is necessary to conclude the Agreement.

  3. E-mail messages sent under the Agreement will be addressed to the e-mail address provided by the Service Recipient at the time of concluding the Agreement.

  4. In order to conclude the Agreement, the Service Recipient provides his or her e-mail address in the subscription form available on the Website, accepts these Terms and gives the required consents. The Agreement is concluded for an indefinite period upon subscription.

  5. For the proper performance of the Agreement, the Service Recipient is obliged to provide a correct e-mail address.

  6. The Bonus in the form of a free video lesson will be delivered to the Service Recipient promptly after the conclusion of the Agreement, but no later than within 7 days of its conclusion, by sending an access link to the e-mail address provided.

  7. The Newsletter is delivered promptly after the Service Provider prepares the messages intended for Service Recipients. The frequency of sending the Newsletter is determined by the Service Provider.

  8. Every message sent as part of the Newsletter will contain information about the possibility of unsubscribing and a link enabling cancellation of the subscription.

  9. The Service Recipient may unsubscribe from the Newsletter at any time, without giving a reason and without incurring any costs, by using the unsubscribe link included in every message or by sending a message to the Service Provider's e-mail address indicated in § 2 of the Terms.

  10. Unsubscribing from the Newsletter results in the immediate termination of the Agreement with respect to the delivery of the Newsletter. Unsubscribing from the Newsletter after receiving the Bonus does not give rise to an obligation to return it, as the Bonus is a one-off performance fulfilled at the time of delivery.

§ 5 COMPLAINTS

I. General provisions

  1. The Service Provider asks that complaints concerning the digital content covered by the Terms be submitted to the postal or e-mail address indicated in § 2 of the Terms.

  2. The Service Provider will respond to a complaint within 14 days of receiving the report.

II. Privileged Service Recipients

  1. The Service Provider is liable to the Privileged Service Recipient for the conformity of the performance with the Agreement, on the terms set out in the Consumer Rights Act.

  2. In the event of improper performance of the Agreement, the Privileged Service Recipient may exercise the rights regulated in Chapter 5b of the Consumer Rights Act.

  3. If the Service Provider has not delivered the digital content covered by the Agreement, the Privileged Service Recipient may call on the Service Provider to deliver it. If, despite the request, the Service Provider does not deliver it without delay or within the agreed time, the Privileged Service Recipient may withdraw from the Agreement.

  4. The Privileged Service Recipient may withdraw from the Agreement without calling on the Service Provider to deliver the digital content if it clearly follows from the Service Provider's statement or from the circumstances that the Service Provider will not deliver the digital content, or if the agreed delivery date was of essential importance to the Privileged Service Recipient and the Service Provider failed to meet that date.

  5. The Service Provider is liable for a lack of conformity of the performance with the Agreement which:

    • with regard to the Newsletter — as content delivered on a continuous basis — occurred or became apparent during the period in which, under the Agreement, it was to be delivered,
    • with regard to the Bonus — existed at the time of its delivery and became apparent within two years of that time.
  6. If the digital content covered by the Terms is not in conformity with the Agreement, the Privileged Service Recipient may demand that it be brought into conformity with the Agreement.

  7. The Privileged Service Recipient is obliged to cooperate with the Service Provider, to a reasonable extent and using the least burdensome technical means, in order to determine whether the lack of conformity with the Agreement does not result from the characteristics of the Service Recipient's digital environment.

  8. The Privileged Service Recipient may submit a statement of withdrawal from the Agreement when:

    • bringing the digital content into conformity with the Agreement is impossible or requires excessive costs,
    • the Service Provider has not brought the digital content into conformity with the Agreement within a reasonable time and without excessive inconvenience to the Privileged Service Recipient,
    • the lack of conformity with the Agreement continues to occur despite the Service Provider's attempts to bring the content into conformity,
    • the lack of conformity with the Agreement is so significant that it justifies withdrawal without first demanding that the content be brought into conformity,
    • it clearly follows from the Service Provider's statement or from the circumstances that the Service Provider will not bring the digital content into conformity with the Agreement within a reasonable time or without excessive inconvenience.

III. Out-of-court complaint resolution methods

  1. The Service Provider informs the Consumer about the possibility of using out-of-court methods of handling complaints and pursuing claims.

  2. The Consumer may, among other things, use the assistance of the competent European Consumer Centre. A list of the centres is available at: https://konsument.gov.pl/eck-w-europie/

  3. In the territory of the Republic of Poland, the following forms of support are available:

    • mediation conducted by the territorially competent Voivodeship Inspectorate of the Trade Inspection: https://uokik.gov.pl/kontakt-inspekcja-handlowa
    • a permanent consumer arbitration court operating at the Voivodeship Inspectorate of the Trade Inspection: https://uokik.gov.pl/kontakt-inspekcja-handlowa
    • free assistance from a municipal or county consumer ombudsman.
  4. Using out-of-court complaint resolution methods is voluntary for both the Service Provider and the Consumer.

§ 6 RIGHT OF WITHDRAWAL FROM THE AGREEMENT

  1. The Privileged Service Recipient has the right to withdraw from the Agreement within 14 days of its conclusion, without giving a reason.

  2. To exercise the right of withdrawal, the Privileged Service Recipient must inform the Service Provider, using the details provided in § 2 of the Terms, of his or her decision by means of an unequivocal statement (e.g. an e-mail message).

  3. The Privileged Service Recipient may use the model withdrawal form placed at the end of the Terms, but this is not mandatory.

  4. To meet the withdrawal deadline, it is sufficient to send the statement before the deadline expires.

  5. With regard to the Bonus in the form of a video lesson: if the Privileged Service Recipient has consented to the commencement of delivery of the Bonus before the expiry of the withdrawal period and has been informed of the loss of the right of withdrawal — the right of withdrawal from the Agreement with respect to the Bonus expires upon the making available of the video lesson.

§ 7 PERSONAL DATA

  1. The controller of the personal data provided by the Service Recipient in connection with the conclusion of the Agreement is the Service Provider. Detailed information on the processing of personal data can be found in the Privacy Policy available on the Website.

  2. The Service Recipient's data is processed for the following purposes:

    • performance of the Agreement, including delivery of the Newsletter and the Bonus — basis: Art. 6(1)(b) GDPR,
    • analysis of the effectiveness of messages sent in order to improve communication — basis: the Service Provider's legitimate interest (Art. 6(1)(f) GDPR),
    • establishing, pursuing or defending potential claims — basis: the Service Provider's legitimate interest (Art. 6(1)(f) GDPR).
  3. Providing data is voluntary, but necessary to conclude the Agreement and to deliver the digital content covered by it.

  4. The Service Recipient's data will be processed until:

    • the Agreement ceases to apply,
    • the possibility of pursuing claims by the Service Recipient or the Service Provider ceases,
    • the Service Recipient's objection to the processing of data is upheld — where the basis for processing was the Service Provider's legitimate interest.
  5. The Service Recipient has the right to request: access to his or her personal data, its rectification, erasure, restriction of processing, transfer of data to another controller, as well as the right to object to the processing of data.

  6. In order to exercise his or her rights, the Service Recipient should contact the Service Provider using the details in § 2 of the Terms.

  7. If the Service Recipient considers that his or her data is being processed unlawfully, he or she may lodge a complaint with the President of the Personal Data Protection Office (UODO).

§ 8 CHANGES TO THE TERMS OR THE NEWSLETTER

  1. The Service Provider reserves the right to change the Terms solely for important reasons, such as:

    • a change in the functionality or format of the Newsletter requiring modification of the Terms,
    • a change in legal provisions affecting the performance of the Agreement,
    • adaptation to recommendations, guidelines or decisions of authorised public authorities,
    • a change in the Service Provider's contact or identification details.
  2. Information about a planned change to the Terms will be sent to the Service Recipient's e-mail address provided when concluding the Agreement, at least 7 days before the changes enter into force.

  3. If the Service Recipient does not object to the planned changes before the date they enter into force, he or she is deemed to accept them. This does not limit the right to terminate the Agreement in the future.

  4. If the Service Recipient does not accept the planned changes, he or she should inform the Service Provider of this at the e-mail address indicated in § 2 of the Terms, which results in the termination of the Agreement upon the entry into force of the changes.

  5. Due to the one-off nature of the Bonus, changes to the Terms do not affect the Agreement with respect to a Bonus that has already been delivered.

  6. The Service Provider may change the format or content of the Newsletter for the reasons indicated in paragraph 1, without additional costs for the Privileged Service Recipient. The provisions of paragraphs 2–4 apply accordingly.

  7. If a change referred to in paragraph 6 materially and adversely affects the Privileged Service Recipient's use of the Newsletter, the Service Provider will inform him or her, with appropriate advance notice, of the change, its characteristics, the date of its introduction and the rights to which he or she is entitled.

§ 9 FINAL PROVISIONS

  1. The Service Recipient is prohibited from providing unlawful content.

  2. The Agreement is concluded in the Polish language.

  3. The Agreement concluded on the basis of these Terms is governed by Polish law, subject to paragraph 4.

  4. The choice of Polish law does not deprive or limit the Consumer of the rights granted to him or her by mandatory provisions of law applicable in his or her place of residence.

  5. In the event of a dispute with a Service Recipient who is not a Privileged Service Recipient, the competent court will be the court competent for the Service Provider's registered office.
